BIOMETRIC DATA PRIVACY POLICY

SOBRsafe, Inc. (the “Company”) operates a touch-based identity verification, alcohol detection and cloud-based reporting system. This system utilizes Biometric Data (defined below) solely for the purpose of identifying individuals. The Company established this Biometric Data Privacy Policy (“Policy”) to ensure such data is reasonably safeguarded and not retained for longer than is necessary. Biometric Data may be created during the alcohol detection process and may be collected from an individual (the “Donor”). This Policy is intended to comply with potentially applicable laws in the state where the Donor’s Biometric Data is collected and/or where the Donor resides.

Definition of Biometric Data

“Biometric Data” means the data generated from the scan of an individual’s finger on the Company’s touch based desktop device, and could include any information that is derived therefrom.

Collection, Use and Access of Biometric Data

The Company’s touch based desktop device works by digitally capturing the individual’s fingerprint. The template is securely stored on the touch based desktop device and is securely stored on a software platform or server database hosted by the Company. The image of a fingerprint is used for the purpose of verification.

The Company and its customers will obtain a written release/consent, as applicable, from each Donor in the form approved by the Company. The form will inform the Donor about (1) the data being collected; (2) the purpose of the collection; and (3) the period of time the Biometric Data will be collected, stored, and used.

The Company and customers will use the Biometric Data captured from the Donor solely for the purposes of verifying a Donor’s identity.

Company employees and agents are permitted to access personal information, including Biometric Data, as necessary and appropriate to carry out their assigned job responsibilities. Consistent with the Company’s access management procedures, certain employees are designated to administer the cloud-based reporting system and, as such, may from time to time need access to Biometric Data.

Disclosure and Retention of Biometric Data

Neither the Company nor the customer will disclose or disseminate any Biometric Data to anyone other than to each other, unless:

  1. Disclosure is required by state or federal law or municipal ordinance.
  2. Disclosure is required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction; or
  3. The Donor has consented to such disclosure or dissemination.

In circumstances where the Company retains Biometric Data, the Company will permanently destroy an individual’s Biometric Data within six months of completion of the purpose for collecting or obtaining such Biometric Data.

Safeguarding Biometric Data

In circumstances where the Company retains Biometric Data, the Company will use a reasonable standard of care to store, transmit and protect from disclosure any paper or electronic Biometric Data collected. Storage, transmission, and protection from disclosure shall be performed in a manner that is the same as or more protective than the manner in which the Company stores, transmits, and protects from disclosure other confidential and sensitive information that is used to uniquely identify an individual.

Amendment

The Company reserves the right to amend this Policy at any time for any reason.
